These Terms and Conditions (“Terms”) govern your access to and use of the Gacha Grails platform, website, and related services (collectively, the “Platform”). By registering an account, making a purchase, or participating in any Mystery Pack Purchase or transaction on the Platform, you agree to be bound by these Terms in full. If you do not agree with any part of these Terms, you must not use the Platform.
1. Definitions
In these Terms, the following words and expressions shall have the meanings set out below:
- “Platform” means the Gacha Grails website, web application, and any future mobile application operated by Geek Grails.
- “User” or “you” means any individual who registers an account or accesses the Platform.
- “Mystery Pack Purchase” or “Mystery Pack” means a draw mechanism through which a User pays a Price Per Card Reveal to receive one Card selected from the Pool, with the identity of the Card to be revealed upon the Card Reveal.
- “Pool” means the rolling collection of Cards made available by Geek Grails for Mystery Pack Purchase at any given time. The Pool is continuously replenished by Geek Grails and does not have a fixed number of Card Reveals or a fixed close date. The Cards included in the Pool and the composition of the Pool are determined by Geek Grails at its sole discretion and may be updated at any time. References in these Terms to “Pool” shall be read as references to the Pool.
- “Card Reveal” means a single draw from the Pool, resulting in the allocation of one Card to the participating User.
- “Price Per Card Reveal” means the Credit cost payable by a User to execute a single Card Reveal, as displayed on the Platform for the Pool.
- “Credits” means the virtual currency purchased by a User through the Platform’s wallet system, used exclusively to participate in Mystery Pack Purchase.
- “Card” means a physical graded or ungraded Trading Card Game collectible item.
- “Market Value” means the estimated fair market value of a Card as determined by Geek Grails by reference to one or more independent third-party marketplaces at the relevant time.
- “Buyback” means the option offered by Geek Grails to repurchase a Card won by a User in a Mystery Pack Purchase, at a price determined by Geek Grails at its sole discretion and credited to the User’s wallet as Credits.
- “We”, “us”, or “Geek Grails” refers to Geek Grails Sdn Bhd (Registration No. 202601016023 (1678120-W)), the operator of the Platform.
- “Business day” means any day on which government offices and banks are open for business and which is not a Saturday, Sunday or a public holiday in Kuala Lumpur and/or Selangor
2. Eligibility
2.1 Participation in Mystery Pack Purchase on the Platform is restricted to registered Users aged 18 years and above. By registering an account, you confirm that you are at least 18 years of age.
2.2 The e-commerce marketplace feature of the Platform is accessible to any member of the public. However, account registration may be required to complete certain transactions.
2.3 The Platform is intended for residents of Malaysia only and the Company does not ship products outside Malaysia.
2.4 Geek Grails reserves the right to verify a User's identity and age at any time and to suspend or terminate accounts where eligibility requirements are not satisfied.
2.5 Employees, directors, and immediate family members of Geek Grails and its related companies are prohibited from participating in Mystery Pack Purchase.
3. Account Registration and Security
3.1 To access the Platform's Mystery Pack Purchase features, you must register an account by providing accurate and complete information, including a valid email address, updated shipping address and contact details.
3.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Geek Grails shall not be liable for any loss or damage arising from unauthorised use of your account.
3.3 You must notify Geek Grails immediately at support@gachagrails.com if you become aware of any unauthorized access to your account.
3.4 You may not create more than one account per individual. Duplicate accounts will be terminated without notice, and any Credits or cards or credit received associated with duplicate accounts may be forfeited.
4. Credits, Wallet, and Payment
4.1 Purchasing Credits
Credits can be purchased through the Platform using accepted payment methods, including credit card and other payment gateways as made available. Credits are denominated in Ringgit Malaysia (RM) at a rate of 1 Credit = RM 1.00 unless otherwise stated on the Platform at the time of purchase.
4.2 Use of Credits
Credits may only be used to participate in Mystery Pack Purchase on the Platform. Credits cannot be used for purchases through the e-commerce marketplace feature; marketplace purchases must be made directly via payment gateway.
4.3 Non-Refundable
All Credit purchases are final and non-refundable, except as required by applicable Malaysian consumer protection law. Credits have no monetary value outside the Platform and cannot be exchanged for cash.
4.4 Credit Expiry
Credits shall remain valid for a period of 12 months from the date of purchase. Any unused Credits shall automatically lapse and be deemed void upon expiry, account closure or termination.
4.5 Referral Credits
Geek Grails may, from time to time, offer Credits as a reward through its referral programme, subject to such terms and conditions as communicated on the Platform at the relevant time.
5. Mystery Pack Purchase (Mystery Pack)
5.1 Nature of Mystery Pack Purchase
Each Mystery Pack is matched to specific physical Cards set aside from our inventory. When you purchase and Open a Mystery Pack, you are paying to receive those Cards together with the on-screen Opening; the Opening is simply a display of a result that was fixed before your purchase was made.
This fixed-allocation model is a core feature of the Platform and sets it apart from any game of chance. The Platform is not a lottery, betting or casino service and does not constitute gambling in any form. Where any rarity or availability information is shown on the Platform, it describes how frequently Cards of a given rarity occur within the Pool; it is provided for information only and does not represent a bet, stake or wager, and you are not gambling against Geek Grails.
5.2 Pool Composition
The Pool is composed of Cards of varying rarity and value, and is continuously restocked by Geek Grails. Geek Grails determines the Cards to be included in the Pool and the composition of the Pool at its sole discretion. Geek Grails reserves the right to change, update, or replenish the contents and composition of the Pool at any time without prior notice.
Information about the Cards available within a Pool, where disclosed, is provided as a general guide only and does not constitute a guarantee of specific Card received for any individual Card Reveal.
5.3 Price Per Card Reveal
The Price Per Card Reveal for each Pool will be displayed on the Platform before a User initiates a Card Reveal. By proceeding with a Card Reveal, the User agrees to pay the stated Price Per Card Reveal in Credits.
5.4 Finality of Card Reveals
Each Card Reveal is final and irreversible. Once a Card Reveal is confirmed, it cannot be cancelled, exchanged, or refunded, except as provided under the Buyback provisions of these Terms. In the event of a verified technical error resulting in a failed Card Reveal, Geek Grails will investigate and, if the error is confirmed, offer a replacement Card Reveal of equivalent value at its discretion.
5.5 Card Values Are Estimates
All Card values and Market Values displayed on the Platform are estimates based on third-party marketplace data and are provided for reference only. Actual resale prices may vary. Geek Grails makes no guarantee that any Card can be resold at the stated Market Value.
5.6 Suspension or Withdrawal of Pools
Geek Grails reserves the right, at its sole discretion and at any time, to suspend, pause, stop, or withdraw any Pool, whether in whole or in part and whether temporarily or permanently, without prior notice. Geek Grails may exercise this right for any reason, including but not limited to operational, technical, commercial, or legal considerations. Where a Pool is suspended or withdrawn, any Card Reveal already validly completed prior to such suspension or withdrawal will be honoured, and any Cards already won will be dealt with in accordance with Section 6. The User acknowledges and agrees that the suspension or withdrawal of a Pool shall not give rise to any dispute, claim, demand, or entitlement to damages or compensation of any kind against Geek Grails.
5.7 Pool Refresh and Real-Time Availability
The Platform operates on a continuously replenishing pool model whereby Cards are made available for Mystery Pack Purchase on an ongoing basis. Geek Grails endeavours to update pool availability in real time; however, Users acknowledge that brief delays in pool refresh may occur from time to time due to factors including but not limited to internet connectivity issues, system maintenance, technical errors, or circumstances beyond Geek Grails' reasonable control.
Geek Grails does not warrant that pool availability as displayed on the Platform at any given time is an exact real-time reflection of the Cards available for draw. Any such delays are temporary in nature and do not affect the validity or Card received of a completed Card Reveal.
Geek Grails shall not be liable for any loss, inconvenience, or claim arising from a delay in pool refresh or a temporary discrepancy in displayed pool availability.
6. Redemption and Buyback
6.1 Redemption Window
Following each successful Card Reveal, the User will have five (5) business days (the “Redemption Window”) to elect one of the following options for each Card won:
- Ship the Card — elect physical shipment of the Card to a designated delivery address, and pay the applicable shipping fee within the Redemption Window; or
- Sell Back (Buyback) — sell the Card back to Geek Grails at the Buyback price offered by Geek Grails at the time of the Card Reveal, credited to the User’s Platform wallet as Credits.
If the User does not make a valid election within the Redemption Window, or elects to Ship the Card but fails to pay the applicable shipping fee in full within the Redemption Window, the Card will by default be bought back by Geek Grails under the Buyback option at the Buyback price offered at the time of the Card reveal, and the corresponding amount will be credited to the User's Platform wallet as Credits. The User acknowledges and agrees that this default Buyback arrangement shall apply automatically in such circumstances and shall not give rise to any dispute, claim, or demand of any kind against Geek Grails.
6.2 Buyback Price
The Buyback price for each Card is determined by Geek Grails at its sole discretion at the time of the relevant Card Reveal. The applicable Buyback price for each Card will be displayed clearly to the User before they confirm the Buyback election. Once confirmed, a Buyback is final and cannot be reversed. If Geek Grails mistakenly credits more than the Buyback amount it offered, it reserves the right to clawback the excess credit. Geek Grails reserves the right to vary, withdraw, or discontinue Buyback offers at any time and without notice. The availability of a Buyback offer in respect of one Pool does not create any expectation or entitlement to the same offer in future Pools.
Buyback proceeds are credited exclusively as Platform Credits and cannot be converted to cash.
6.3 Cards Repurchased via Buyback
Cards repurchased by Geek Grails under the Buyback scheme may be re-entered into the Platform's inventory and made available in future Pools.
6.4 No Liability for Market Fluctuations
Geek Grails accepts no liability for any decline in Market Value between the date of the Card Reveal and the date of Buyback or shipment, or at any time thereafter.
7. Shipping and Delivery
7.1 Geek Grails will ship Cards elected for delivery to the address registered in your account. You are responsible for ensuring that your delivery address is accurate and complete. Geek Grails shall not be liable for non-delivery resulting from an incorrect address provided by the User.
7.2 All Cards elected for shipment by a User will be consolidated into a single shipment where operationally practicable.
7.3 Estimated delivery timelines will be communicated on the Platform. Geek Grails shall not be liable for delays in delivery caused by third-party logistics providers, force majeure events, or circumstances outside Geek Grails' reasonable control.
7.4 Upon dispatch, a tracking number will be provided via your registered account or email.
7.5 Shipping fees, where applicable, will be disclosed to the User prior to confirmation of shipment.
7.6 Geek Grails does not currently offer international shipping. Delivery is available within Malaysia only.
8. Card Authenticity and Condition
8.1 All Cards listed on the Platform have been subject to Geek Grails' internal authenticity and condition verification process prior to entry into the inventory pool. This includes physical inspection, certification number verification, and grading checks where applicable.
8.2 Graded cards are graded by third-party professional grading services (e.g., PSA, BGS). Geek Grails makes no representation regarding, and accepts no liability for, the grading standards or decisions of such third parties.
8.3 Condition descriptions and grading information displayed on the Platform are provided in good faith based on information available at the time of listing. Minor condition variations that do not materially affect the grading of a Card do not constitute grounds for refund or complaint.
8.4 If a Card received by a User is materially different from its description (e.g., incorrect card delivered, counterfeit card), the User may request for a refund, return or exchange (where applicable) in accordance with the Return, Refund and Exchange Policy.
9. E-Commerce Marketplace
9.1 General
In addition to Mystery Pack Purchase, the Platform offers direct purchase of Cards through an e-commerce marketplace (“Marketplace”). The Marketplace is operated solely by Geek Grails and is accessible to any member of the public. All Marketplace purchases are subject to these Terms and any additional terms displayed at the point of checkout. By completing a purchase on the Marketplace, you agree to be bound by these Terms in full.
9.2 Payment
All Marketplace purchases must be paid for in full at the time of order via accepted payment gateways, including credit card or such other methods as made available on the Platform. Credits cannot be used for Marketplace purchases. An order is not confirmed until full payment has been successfully processed and Geek Grails has issued an order confirmation to the buyer.
9.3 Pre-Dispatch Condition Documentation
All Cards are packaged by Geek Grails to a reasonable standard prior to dispatch, and Geek Grails photographs and records the condition of every Card prior to packaging and dispatch. This documentation constitutes Geek Grails' authoritative record of the condition of the Card at the point it left Geek Grails' premises.
Risk of loss, damage, or deterioration of a Card passes to the buyer upon handover of the Card to the logistics provider. Geek Grails shall not be liable for any damage, loss, or deterioration occurring during transit. Claims for transit damage must be directed to the relevant logistics provider. Geek Grails will, upon request, provide the buyer with copies of pre-dispatch condition photographs and dispatch records to assist with any carrier claim.
9.4 Sales Are Final — No Refund Policy
All Marketplace sales are final upon payment confirmation. Geek Grails does not offer refunds, returns, or exchanges for Marketplace purchases, except in the strictly limited circumstances in accordance with the Return, Refund and Exchange Policy.
You expressly acknowledge that: (a) Card values are subject to market fluctuation; (b) Geek Grails makes no representation that any Card will retain or increase in value after purchase; (c) a change in market value after the date of purchase does not constitute grounds for a refund or cancellation; and (d) damage occurring during transit after dispatch is not Geek Grails' liability and does not entitle the buyer to a refund from Geek Grails.
9.5 Chargebacks and Payment Disputes
By completing a purchase on the Marketplace, you agree not to initiate a chargeback, payment reversal, or dispute with your payment provider or financial institution in respect of that purchase, except where you have first raised the matter with Geek Grails in accordance with Section 9.5 and Geek Grails has failed to respond or resolve the matter within 14 days.
Initiating a chargeback without first following the dispute process in Section 9.5 constitutes a material breach of these Terms. In such circumstances, Geek Grails reserves the right to: (a) suspend or permanently terminate your account; (b) forfeit any Credits held in your wallet; (c) pursue recovery of the full value of the disputed transaction together with any associated chargeback fees, administrative costs, and legal expenses incurred by Geek Grails; and (d) report the matter to relevant authorities where fraud is suspected.
9.6 Card Listings and Descriptions
All Card listings on the Marketplace are prepared by Geek Grails in good faith based on information available at the time of listing. Card images, descriptions, and grading information are provided for reference purposes only. Geek Grails reserves the right to correct any manifest error in a listing at any time prior to order confirmation. Where an error is identified after order confirmation, Geek Grails will notify the buyer and offer either: (a) confirmation of the order at the corrected terms; or (b) cancellation and a full refund of the amount paid.
9.7 Pricing
All prices displayed on the Marketplace are in Ringgit Malaysia (RM) and are inclusive of any applicable taxes unless otherwise stated. Geek Grails reserves the right to amend pricing at any time without notice. The price applicable to your purchase is the price displayed at the time your order is confirmed.
9.8 Availability
All Cards listed on the Marketplace are subject to availability. Geek Grails reserves the right to cancel any order where the relevant Card is no longer available, in which case a full refund of the amount paid will be issued. Geek Grails shall have no further liability to the User in such circumstances.
10. Prohibited Conduct
You agree that you will not:
- Use the Platform for any unlawful purpose or in violation of applicable Malaysian law;
- Attempt to manipulate, exploit, or hack any aspect of the Platform, including but not limited to the draw algorithm, wallet system, or inventory system;
- Use automated scripts, bots, or other software to interact with the Platform;
- Create multiple accounts to circumvent account restrictions or exploit promotions;
- Engage in fraudulent transactions, including chargebacks made in bad faith;
- Resell Credits or facilitate the transfer of Credits to other Users outside the Platform's official referral programme;
- Post or transmit any content that is defamatory, offensive, or harmful to Geek Grails or other Users;
- Impersonate any person or entity, including Geek Grails staff; or
- Attempt to reverse-engineer, decompile, or otherwise tamper with the Platform's technology.
Breach of this clause may result in immediate account suspension or termination and forfeiture of Credits without refund.
11. Intellectual Property
11.1 All content on the Platform, including but not limited to the Geek Grails name, logo, trade marks, website design, software, and text, is the property of Geek Grails or its licensors and is protected by applicable intellectual property laws.
11.2 You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes only. You must not reproduce, distribute, modify, or create derivative works from any Platform content without Geek Grails' prior written consent.
11.3 Trading Card Game card images, names, and related intellectual property remain the property of their respective owners. Geek Grails does not claim ownership of any third-party intellectual property.
12. Privacy and Data Protection
12.1 Geek Grails collects, uses, and processes personal data in accordance with its Privacy Policy, available at www.gachagrails.com/privacy, and in compliance with the Personal Data Protection Act 2010 (Malaysia) (“PDPA”).
12.2 By registering an account, you consent to Geek Grails collecting and processing your personal data for the purposes of operating the Platform, processing transactions, communicating with you, and complying with legal obligations.
12.3 Geek Grails will not sell your personal data to third parties. Data may be shared with logistics providers, payment processors, and other service providers strictly as necessary for Platform operations.
12.4 You have the right to access, correct, or withdraw consent to the processing of your personal data, subject to applicable law. Requests may be directed to support@gachagrails.com.
13. Disclaimer and Limitation of Liability
13.1 The Platform and all content, services, and Cards are provided on an “as is” and “as available” basis. Geek Grails makes no warranties, express or implied, regarding the Platform’s uninterrupted availability, or freedom from errors.
13.2 Geek Grails shall not be liable for any loss of profits, revenue, data, goodwill, or any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform.
13.3 Geek Grails' total aggregate liability to any User in connection with any claim arising from use of the Platform shall not exceed the total amount of Credits purchased by that User in the 30-day period immediately preceding the event giving rise to the claim.
13.4 Nothing in these Terms shall limit or exclude Geek Grails' liability for fraud, death, or personal injury caused by Geek Grails' negligence, or any liability that cannot be excluded by applicable Malaysian law.
13.5 You acknowledge that the market value of the Card fluctuates and may be higher or lower than the Pack Price paid and Users may receive Cards of a value less than the Price Per Card Reveal paid in Mystery Pack Purchase.
14. Suspension and Termination
14.1 Geek Grails reserves the right to suspend or terminate your account and access to the Platform at any time, with or without notice, if you breach these Terms or if Geek Grails reasonably suspects fraudulent, abusive, or unlawful activity.
14.2 Upon termination of your account for breach, fraudulent, abusive or unlawful activity, any remaining Credits in your wallet shall be forfeited without compensation.
14.3 You may voluntarily close your account at any time by contacting support@gachagrails.com. Unused Credits remaining at the time of voluntary closure may be refunded at Geek Grails’ discretion and subject to verification of identity.
14.4 Any Cards that have been won but not yet shipped or bought back at the time of account termination will be handled as follows: Geek Grails will contact the User to arrange shipment. If the User cannot be contacted within 30 days, the Cards will be returned to Geek Grails' inventory.
15. Amendments to Terms
15.1 Geek Grails reserves the right to amend these Terms at any time. Changes will be posted on the Platform with the updated effective date. Continued use of the Platform following the posting of changes constitutes acceptance of the revised Terms.
15.2 For material changes, Geek Grails will endeavour to provide at least 14 days' prior notice to registered Users via email or in-platform notification.
16. Governing Law and Dispute Resolution
16.1 These Terms shall be governed by and construed in accordance with the laws of Malaysia.
16.2 Any dispute arising out of or in connection with these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation between the parties.
16.3 If a dispute cannot be resolved through negotiation within 30 days, the parties agree to submit the dispute to the exclusive jurisdiction of the courts of Malaysia.
17. General Provisions
17.1 Entire Agreement. These Terms, together with the Privacy Policy and any other policies published on the Platform, constitute the entire agreement between you and Geek Grails with respect to your use of the Platform.
17.2 Severability. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
17.3 No Waiver. Geek Grails' failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
17.4 Assignment. You may not assign or transfer any rights or obligations under these Terms without Geek Grails' prior written consent. Geek Grails may assign its rights and obligations under these Terms without restriction.
17.5 Force Majeure. Geek Grails shall not be in breach of these Terms or liable for any delay or failure in performance resulting from causes beyond its reasonable control, including natural disasters, government actions, pandemic, or failure of third-party services.
